Getting married as a foreign national in the Czech Republic is often connected with a number of legal requirements, administrative formalities, and specific documents that must be properly prepared before the wedding ceremony itself. A missing document, incorrect certification, or late submission may significantly complicate or delay the entire process. With timely legal assistance, however, most problems can be easily avoided so that the marriage process for foreigners proceeds smoothly.</em></p>
<h2 data-section-id="1epc3hh" data-start="552" data-end="602">What documents must a foreign national submit?</h2>
<p data-start="603" data-end="685">A foreign national usually submits the following documents to the registry office:</p>
<ul data-start="687" data-end="1101">
<li data-section-id="c06xg4" data-start="687" data-end="707">birth certificate,</li>
<li data-section-id="1w6xuza" data-start="708" data-end="744">identity document (e.g. passport),</li>
<li data-section-id="bn5dn1" data-start="745" data-end="768">proof of citizenship,</li>
<li data-section-id="51bkuy" data-start="769" data-end="841">certificate of legal capacity to marry, if issued by the home country,</li>
<li data-section-id="1vmwn5j" data-start="842" data-end="889">confirmation of marital status and residence,</li>
<li data-section-id="kjti6z" data-start="890" data-end="936">final divorce decree, if previously married,</li>
<li data-section-id="sggh0m" data-start="937" data-end="1011">death certificate of a deceased spouse, in the case of a widowed person,</li>
<li data-section-id="wtussv" data-start="1012" data-end="1101">and possibly other documents depending on the specific situation of the engaged couple.</li>
</ul>
<p data-start="1103" data-end="1287">If a foreign national has long-term residence in a country other than the one of their citizenship, confirmation of marital status and residence from that country may also be required.</p>
<h2 data-section-id="1soihtz" data-start="1289" data-end="1324">Confirmation of legal residence</h2>
<p data-start="1325" data-end="1640">Foreign nationals from countries outside the European Union are generally required to submit confirmation from the Police of the Czech Republic proving their legal residence in the Czech Republic before the marriage can take place. This confirmation must not be older than 7 working days on the date of the wedding.</p>
<p data-start="1642" data-end="1789">This obligation does not apply to citizens of European Union member states, European Economic Area countries, Switzerland, or their family members.</p>
<h2 data-section-id="c9gkp7" data-start="1791" data-end="1851">Apostille, superlegalization, and certified translations</h2>
<p data-start="1852" data-end="2063">In most cases, foreign public documents must be officially certified — most commonly with an apostille or superlegalization. At the same time, certified translations into the Czech language are usually required.</p>
<p data-start="2065" data-end="2266">As each country has different rules and requirements, I recommend handling everything well in advance to ensure that your marriage process in the Czech Republic goes smoothly and without complications.</p>

										<content:encoded><![CDATA[<p data-start="0" data-end="211"><em>Holders of an employee card are required to report a change of employer or job position to the Ministry of the Interior of the Czech Republic. This obligation also applies to holders of a non-dual employee card.</em></p>
<p data-start="213" data-end="384"><em>Failure to comply with this obligation may have serious consequences for foreign nationals, including the loss of validity of their residence permit in the Czech Republic.</em></p>
<h3 data-section-id="la2v8r" data-start="386" data-end="412">Standard Employee Card</h3>
<p data-start="414" data-end="735">If you do not have free access to the labor market, you must notify the authorities of a change of employer or job position before starting your new job. You may begin the new employment or position only after receiving written confirmation (“Notification of Fulfillment of Conditions”) from the Ministry of the Interior.</p>
<h3 data-section-id="ucg14d" data-start="737" data-end="773">Deadlines for Reporting a Change</h3>
<h4 data-start="775" data-end="842">No later than 90 days after termination of previous employment</h4>
<p data-start="844" data-end="1039">From the date your employment ends, you have 90 days to find a new job and notify the Ministry of the Interior of the change, or to apply for a new long-term residence permit for another purpose.</p>
<p data-start="1041" data-end="1107">If you fail to meet this deadline, your employee card will expire.</p>
<p data-start="1109" data-end="1241">The notification must be delivered to the Ministry no later than the 90th day — simply mailing it on the 90th day is not sufficient.</p>
<p data-start="1243" data-end="1348">You may search for a new job and prepare the notification while still employed by your previous employer.</p>
<h3 data-section-id="j33qvr" data-start="1350" data-end="1392">When Can You Start the New Employment?</h3>
<h4 data-start="1394" data-end="1457">Earliest 6 months after receiving your first employee card</h4>
<p data-start="1459" data-end="1492">This condition does not apply if:</p>
<ul data-start="1494" data-end="1615">
<li data-section-id="swat4s" data-start="1494" data-end="1557">the employee card has already been extended at least once, or</li>
<li data-section-id="pt4bdm" data-start="1558" data-end="1615">you are only changing positions with the same employer.</li>
</ul>
<p data-start="1617" data-end="1850">The condition also does not apply if your previous employment ended for reasons stated in Sections 56 and 52(a)–(e) of the Czech Labor Code, by agreement under Section 52(a)–(e), or through termination during the probationary period.</p>
<h4 data-start="1852" data-end="1911">Earliest 30 days after reporting the employment change</h4>
<p data-start="1913" data-end="1947">Both conditions must be fulfilled!</p>
<h3 data-section-id="8x5oly" data-start="1949" data-end="1986">What Documents Must Be Submitted?</h3>
<ul data-start="1988" data-end="2423">
<li data-section-id="zoq7b8" data-start="1988" data-end="2006">Application form</li>
<li data-section-id="1hlnd83" data-start="2007" data-end="2115">A document confirming that the previous employment is ongoing or has ended, including the termination date</li>
<li data-section-id="1g3c12u" data-start="2116" data-end="2251">Employment contract, agreement on work activity, future employment contract, or future work activity agreement for the new employment</li>
<li data-section-id="e5vy0" data-start="2252" data-end="2423">Documents proving professional qualifications for the position, or a written declaration from the employer confirming professional qualifications (only in certain cases)</li>
</ul>
<h3 data-section-id="cmdgr4" data-start="2425" data-end="2476">What Happens if You Do Not Meet the Conditions?</h3>
<p data-start="2478" data-end="2650">The notification will be considered invalid — the result will be the same as if you had not reported the change at all. In extreme cases, the employee card may even expire.</p>
<h3 data-section-id="y1h4o2" data-start="2652" data-end="2687">Free Access to the Labor Market</h3>
<p data-start="2689" data-end="2888">If you have free access to the labor market, you may start your new employment at any time and do not need to wait for the Ministry of the Interior to issue confirmation of fulfillment of conditions.</p>
<p data-start="2890" data-end="2989">However, you must report the change no later than 3 working days after starting the new employment.</p>
<h3 data-section-id="1svdxdx" data-start="2991" data-end="3030">How and Where to Report the Change?</h3>
<p data-start="3032" data-end="3085">A change of employer may be reported in several ways:</p>
<ul data-start="3087" data-end="3337">
<li data-section-id="3okmx7" data-start="3087" data-end="3156">using the special form provided by the Ministry of the Interior, or</li>
<li data-section-id="1l7lkgz" data-start="3157" data-end="3294">by submitting a free-form notification including at least:
<ul data-start="3220" data-end="3294">
<li data-section-id="158grks" data-start="3220" data-end="3238">employer’s name,</li>
<li data-section-id="2ij1ub" data-start="3241" data-end="3272">employer’s registered office,</li>
<li data-section-id="1ymwtre" data-start="3275" data-end="3294">place of work, or</li>
</ul>
</li>
<li data-section-id="fyu6yq" data-start="3295" data-end="3337">by submitting a new employment contract.</li>
</ul>
<p data-start="3339" data-end="3373">The notification may be submitted:</p>
<ul data-start="3375" data-end="3549">
<li data-section-id="12afze5" data-start="3375" data-end="3424">in person at a Ministry of the Interior office,</li>
<li data-section-id="12jbhl3" data-start="3425" data-end="3435">by post,</li>
<li data-section-id="1145vxy" data-start="3436" data-end="3455">via data mailbox,</li>
<li data-section-id="5ff5jf" data-start="3456" data-end="3509">by email with a recognized electronic signature, or</li>
<li data-section-id="m4jzvq" data-start="3510" data-end="3549">through an authorized representative.</li>
</ul>

<p data-start="502" data-end="580">Up to 2 years, depending on the duration of the employment or the work permit.</p>

<p data-start="611" data-end="772">The holder must fulfill the purpose of the stay, report any changes in employer or job position, and apply for a new permit within 60 days of losing their job.</p>
</li>

<p data-start="775" data-end="902">It is also recommended to regularly check whether the employer is considered unreliable (e.g., has debts to the tax authority).</p>
</li>
</ul>

<p data-start="3354" data-end="3729">Fulfilling all the conditions for obtaining an employee card can be very complicated for many foreigners, especially if they do not speak Czech or are unfamiliar with the Czech legal system. <p data-start="52" data-end="190"><em>EU citizens and their family members can apply for permanent residence in the Czech Republic after five or two years of temporary stay.</em></p>
<p data-start="192" data-end="505"><em>In this article, you will first learn what conditions must be met to obtain permanent residence, how the entire process works, and what advantages permanent residence has compared to temporary residence. The procedure is similar for EU citizens and for family members of EU citizens who come from third countries.</em></p>

<p data-start="1848" data-end="2130">A key advantage of this type residence is its long validity. The biometric card can be issued for up to ten years. For family members of EU citizens, it is also important that their residence remains valid even if they lose their status as a family member (e.g., due to divorce).</p>

The application must be submitted exclusively within the territory of the Czech Republic, and the applicant may stay there until the Ministry of the Interior issues a decision. Furthermore, close family members of EU citizens are eligible for residence more easily than extended family members.</em></p>

<p data-start="1246" data-end="1360">In person at a branch of the Ministry of the Interior of the Czech Republic.</p>

<p data-start="1367" data-end="1546">No later than 3 months after entering the Czech Republic, the expiration of a previous permit, or the moment you become a close family member of an EU citizen.</p>

<p data-start="1553" data-end="1747">You are legally residing in the Czech Republic while your application is being processed, even if your visa or previous permit expires in the meantime.</p>

Applications can be submitted <strong data-start="3456" data-end="3501">in person at the Ministry of the Interior</strong>, <strong data-start="3503" data-end="3514">by mail</strong>, <strong data-start="3516" data-end="3532">via data box</strong>, <strong data-start="3534" data-end="3575">by email with an electronic signature</strong>, or <strong data-start="3580" data-end="3620">through an authorized representative</strong>.</p>

										<content:encoded><![CDATA[<p class="" data-start="105" data-end="489">If an EU citizen wishes to settle in the Czechia for the long term, they do not need to apply for a residence permit. However, they may optionally apply for a Registration Certificate. This certificate can be useful for proving (e.g., when dealing with Czech authorities, banking institutions, etc.) that the EU citizen is residing in the Czech Republic long term.</p>
<h4 data-start="491" data-end="788"><strong data-start="491" data-end="509">Who can apply</strong></h4>
<p data-start="491" data-end="788">All citizens of the European Union, Iceland, Liechtenstein, Norway, and Switzerland. Additionally, citizens of the United Kingdom of Great Britain and Northern Ireland, provided they were residing in the country as of December 31, 2020 (according to the Withdrawal Agreement).</p>
<h4 data-start="790" data-end="996"><strong data-start="790" data-end="833">Validity of certificate</strong></h4>
<p data-start="790" data-end="996">EU citizens – 10 years.<br data-start="863" data-end="866" />UK citizens – 5 years.<br data-start="892" data-end="895" />After five years of residence in the Czech Republic, it is possible to apply for permanent residence.</p>
<h4 data-start="998" data-end="1482"><strong data-start="998" data-end="1059">What are the benefits of the Certificate of Registration</strong></h4>
<p class="" data-start="998" data-end="1482">As part of the application process, EU citizens will also receive a personal identification number (if they don’t already have one). If they plan to apply for permanent residence in the future, the certificate helps to prove the duration of their stay in the Czech Republic. Furthermore, it allows EU citizens to vote in municipal elections in the locality where they reside, as well as in European Parliament elections.</p>
<h4 data-start="1484" data-end="1635"><strong data-start="1484" data-end="1501">How to apply</strong></h4>
<p class="" data-start="1484" data-end="1635">EU citizens can submit their application in person at the Ministry of the Interior, by mail, or a data-box.</p>

<p class="" data-start="1637" data-end="1782">An EU citizen can apply at any time if they plan to stay in the Czech Republic long term (generally for more than 3 months).</p>

<h4 data-start="2472" data-end="2914"><strong data-start="2472" data-end="2587">What do I need to do if I want to live in the Czech Republic long-term without the Certificate of Registration</strong></h4>
<p class="" data-start="2472" data-end="2914">An EU citizen is required to report their place of residence to the police within 30 days of entering the country, if their expected stay will exceed 30 days. This obligation does not apply if the foreigner has fulfilled this duty through their accommodation provider. Reporting must be done in person at the Foreign Police.</p>
