Love knows no borders — unfortunately, bureaucracy does. Getting married as a foreign national in the Czech Republic is often connected with a number of legal requirements, administrative formalities, and specific documents that must be properly prepared before the wedding ceremony itself. A missing document, incorrect certification, or late submission may significantly complicate or delay the entire process. With timely legal assistance, however, most problems can be easily avoided so that the marriage process for foreigners proceeds smoothly.
What documents must a foreign national submit?
A foreign national usually submits the following documents to the registry office:
- birth certificate,
- identity document (e.g. passport),
- proof of citizenship,
- certificate of legal capacity to marry, if issued by the home country,
- confirmation of marital status and residence,
- final divorce decree, if previously married,
- death certificate of a deceased spouse, in the case of a widowed person,
- and possibly other documents depending on the specific situation of the engaged couple.
If a foreign national has long-term residence in a country other than the one of their citizenship, confirmation of marital status and residence from that country may also be required.
Confirmation of legal residence
Foreign nationals from countries outside the European Union are generally required to submit confirmation from the Police of the Czech Republic proving their legal residence in the Czech Republic before the marriage can take place. This confirmation must not be older than 7 working days on the date of the wedding.
This obligation does not apply to citizens of European Union member states, European Economic Area countries, Switzerland, or their family members.
Apostille, superlegalization, and certified translations
In most cases, foreign public documents must be officially certified — most commonly with an apostille or superlegalization. At the same time, certified translations into the Czech language are usually required.
